Welcome to Bihar Kayastha Ganna 2026 ("Platform", "Service", "Website", "we", "us", "our"). By accessing or using this Platform, you ("User", "You", "Your") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THIS PLATFORM OR SUBMIT ANY INFORMATION.

These Terms constitute a legally binding agreement between you and the Platform operators. Your use of the Platform constitutes acceptance of these Terms.

This Platform facilitates a voluntary census of the Kayastha community in Bihar for demographic and statistical purposes. The Platform allows users to:

• Register family information
• Submit demographic data
• View aggregated statistics (where available)

IMPORTANT: This is NOT an official government census. Participation is entirely voluntary. We are not affiliated with any government body or official census organization.

3. Eligibility and User Representations

By using this Platform, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into binding agreements
• You have the authority to provide information about yourself and your family members
• All information you provide is accurate, complete, and truthful
• You will not use the Platform for any unlawful or prohibited purpose
• You will comply with all applicable laws and regulations

4. User Obligations and Prohibited Conduct

You agree that you will NOT:

• Submit false, misleading, or inaccurate information
• Impersonate any person or entity
• Upload viruses, malware, or malicious code
• Attempt to hack, disrupt, or compromise Platform security
• Scrape, crawl, or extract data using automated means
• Reverse engineer or decompile any part of the Platform
• Use the Platform for commercial purposes without authorization
• Violate any applicable laws or regulations
• Harass, abuse, or harm other users
• Access or attempt to access data of other users
• Create multiple accounts or fake registrations
• Interfere with the proper functioning of the Platform

Violation of these terms may result in immediate termination of access and legal action.

All content, features, and functionality of this Platform, including but not limited to:

• Text, graphics, logos, designs, images
• Software, code, and algorithms
• User interface and navigation
• Compilation of data and statistics

are the exclusive property of the Platform operators and are protected by Indian and international copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works without express written permission.

Exclusive Jurisdiction: Any legal action, suit, or proceeding arising out of or relating to these Terms or the Platform shall be instituted exclusively in the courts of Patna, Bihar, India. You consent to the jurisdiction and venue of such courts and waive any objection to such jurisdiction or venue.

18. Dispute Resolution

In the event of any dispute arising from these Terms or use of the Platform:

1. Informal Resolution: You agree to first attempt to resolve the dispute informally by contacting us at grievance@biharkayasthaganna.org
2. Mediation: If informal resolution fails within 30 days, parties may agree to mediation
3. Arbitration (Optional): Disputes may be settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996, in Patna, Bihar
4. Litigation: As a last resort, disputes shall be resolved in the courts of Patna, Bihar

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If such modification is not possible, the provision shall be severed from these Terms, and the remaining provisions shall remain in full force and effect.

20. Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

21. Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may assign these Terms and our rights hereunder without restriction.
